JSC interviews to go ahead despite MKP threats of legal action

The Judicial Service Commission (JSC) has resolved to go ahead with its October sitting, despite the uMkhonto weSizwe Party’s threat of legal action and demonstrations.

The JSC held an urgent virtual meeting yesterday, after it received a letter from MK Party lawyers, seeking a postponement of the sitting from the 7th to the 11th of this month.

This request follows an interim interdict granted by a full bench of the Western Cape High Court halting Dr John Hlophe from participating in the JSC sitting, pending a review of his designation to the JSC.

Attorneys on behalf of the MK party contended that the effect of the interdict renders the JSC “improperly constituted”.

JSC Chairperson, Chief Justice of the Republic of South Africa, Mandisa Maya, however, in a response to the MK – dated Tuesday, 1 October 2024 – noted that the judgment of the Western Cape High Court does not impact the composition of the JSC and therefore the commission remains lawfully composed.
