Evidence leader Advocate Matthew Chaskalson has put it to North West businessman Brown Mogotsi that his text message to Police Minister Senzo Mchunu regarding a “breakthrough”, has nothing to do with an operation at Stilfontein.
Signal messages between Mchunu and Mogotsi show that the businessman was in constant communication with Mchunu, who has been placed on special leave, days after a raid was conducted at Vusi ‘Cat’ Matlala’s property.
The raid was conducted by PKTT members.
However, Mogotsi has denied that it had anything to do with PKTT members.
Evidence leader: “If there was a breakthrough, it means it would’ve been that IPID guy.”
Mogotsi: “I cannot remember this message.”
Evidence leader: “Let me suggest you another breakthrough that might have been? You may have been told that there are grounds to arrest members of the PKTT for allegedly assaulting Mr Matlala. And you may have reported that to the Minister as breakthrough. Probably that may have been a prophecy from somewhere.”
Earlier, Commission Chairperson Mbuyiseli Madlanga put it to Mogotsi that he doesn’t value his oath.
Justice Madlanga’s comments come as Mogotsi was caught in a lie on Wednesday, when he misrepresented himself in an affidavit stating that he works for the office of the police minister.
But Mogotsi has responded that the questions being put to him are suppressing him.
Mogotsi: “Commissioner, would I be allowed to say something.”
Justice Madlanga: “Can you just answer that question, would you consider that oath to be binding on your conscious.”
Mogotsi: “For the purpose of the mission I was undertaking commissioner, it was the only way to execute the mission.”
Justice Madlanga: “Can you now answer the question directly. Did you consider that oath to be bidding on your conscious. Yes or no. You’ve given an explanation now I want a direct answer to my question.”
